CLARITY Act Fallout: $8 Million in Lobbying Fails to Close the Deal as Rulemaking Takes Over
The crypto industry’s expensive push for comprehensive U.S. market-structure legislation has ended in failure. CoinDesk reported on October 1 that the industry spent $8 million on lobbyists who did not close the deal on the CLARITY Act, including spending by Coinbase and Kraken, with total industry lobbying reaching $13 million.
The Digital Asset Market Clarity Act (H.R. 3633) died on September 15, 2026, when the Senate voted 49 to 50 on the motion to invoke cloture at 2:15 p.m. ET — eleven votes short of the 60 required to open floor debate, with one senator not voting. The failure was not about the market-structure framework itself. It broke on unresolved political disputes: ethics provisions addressing government officials’ ties to the crypto industry, illicit finance provisions under Section 604, stablecoin yield language, and a split between the Senate Banking and Agriculture Committee versions. Four Republicans — Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis — voted no.
With the fall Senate calendar now dominated by election-year politics and must-pass spending bills, there is no realistic legislative window left in 2026; the next chance would be 2027 at the earliest, after the November midterms.
The regulatory burden now falls entirely on federal agencies. SEC Chairman Paul Atkins has said the agency will deliver for investors and innovators with or without legislation, pointing to “Regulation Crypto Assets” as the operative framework. Three rulemaking deadlines now shape the landscape: the Treasury Department’s proposed stablecoin-issuer rule has a comment period closing October 17; the OCC has a November rule in motion; and the GENIUS Act’s provisions take effect in January 2027.
Why it matters: The legislative path to U.S. crypto market structure is blocked until at least 2027, so the industry’s rules will now be written by agency regulators whose actions can be reversed by future administrations — a less stable foundation for the market’s next growth phase.
